Terms of Service
Clear terms. Clear responsibilities.
A clear basis for your visit.
These terms explain how you may use our website and contact forms. They distinguish general website information from a professional engagement, and website operation from the company providing your services.
Operator and scope
Who operates this website.
This website is operated by mse Business Consulting GmbH, Manfred-Wörner-Straße 115, 73037 Göppingen, Germany. These Terms of Service concern the use of the website and its contact facilities.
mse Process Consulting LLC is the US business presented on these pages. Website operation does not determine which company becomes your contracting partner for consulting, software, licensing, support, or project work. That company and the applicable commercial terms are identified in the relevant offer or separate agreement.

Website information
Information before an individual agreement.
The website provides general information about mse, products, and services. Its descriptions are not, by themselves, a binding offer, a promise of specific project results, or advice tailored to your individual situation.
Product suitability, scope, pricing, availability, and any service commitments must be assessed for your requirements and agreed with the relevant company. These website terms do not replace or amend a separate contract, license, service-level agreement, or support agreement.
Contact forms
A message is an inquiry, not an order confirmation.
Our contact form is provided to help you communicate with mse. Please provide accurate contact information and send only information that you are entitled to share.
Submitting a form, receiving a technical success message, or receiving an acknowledgment does not by itself mean that mse has accepted an order, entered into a professional engagement, or agreed to a response deadline.
Information you send is handled as described in our Privacy Policy. The rules on statutory liability in section 6 remain unaffected.
Acceptable use
Use the website for lawful communication.
You must not use the website or its forms to send unlawful content, spam, malware, or misleading messages; infringe another person’s rights; attempt unauthorized access; or deliberately disrupt the website or its infrastructure.
Do not submit another person’s personal information unless you are authorized to do so. Avoid sending sensitive information that is not needed for your inquiry.
Content and links
Respect content and third-party rights.
Website texts, images, designs, logos, and other materials may be protected by copyright, trademark, or other rights belonging to mse or the respective rights holders. Product names and third-party marks remain the property of their respective owners.
You may view the website and make the technical copies needed for normal browsing. Further reproduction, modification, publication, or commercial use requires permission from the relevant rights holder unless permitted by applicable law or an applicable license.
External links lead to websites operated by third parties. Their content, terms, and privacy practices are their responsibility. Any legal duties that apply to our own linking activity remain unaffected.
Availability and liability
Clear limits, with mandatory protections preserved.
We take reasonable care in preparing website information and making the website available. Content may need updating, and maintenance, interruptions, delays, or transmission errors may occur. We do not promise uninterrupted access or error-free electronic communication.
The following rules concern claims for damages arising from use of this informational website and its contact facilities. They do not govern liability under a separate consulting, software, licensing, support, or project agreement.
Liability without limitation. We remain liable without limitation for intentional misconduct and gross negligence, and for loss of life, personal injury, or damage to health caused by a negligent or intentional breach of duty by us, our legal representatives, or persons acting on our behalf in performing our obligations. Liability for fraudulent concealment, under an expressly assumed guarantee within its scope, under the German Product Liability Act, or under any other mandatory legal provision also remains unaffected.
Ordinary negligence. Except in the cases above, where damages result from an ordinarily negligent breach of an essential contractual obligation, our liability is limited to the loss that was reasonably foreseeable and typical for the relevant contractual relationship when it was established. An essential contractual obligation is one whose performance is necessary to achieve the purpose of that relationship and on whose performance you may ordinarily rely. In other cases of ordinary negligence, liability for damages is excluded.
These limitations apply only to the extent permitted by applicable law. They also apply to the personal liability of our legal representatives, employees, and persons acting on our behalf in performing our obligations, subject to the same exceptions above. Nothing in these terms excludes or limits any liability or remedy that cannot lawfully be excluded or limited. Your mandatory legal rights remain unaffected.
Any service commitments and liability arrangements in a separate professional agreement are governed by that agreement and applicable law, not by a general statement on this website.
Personal information
Privacy information has its own clear reference.
Our Privacy Policy describes the website’s cookie-free and tracking-free operation and how personal information actively submitted through contact or applications is handled. These terms do not create a separate permission to use your information for unrelated purposes.
Governing law
German law, with mandatory protections preserved.
These website terms are governed by the laws of the Federal Republic of Germany. This choice of law does not deprive you of protection under mandatory provisions that apply regardless of that choice.
Jurisdiction is determined by applicable law. Separate business agreements may contain their own law and jurisdiction provisions, subject to applicable legal requirements.
Updates and contact
A visible reference for future changes.
We may update these website terms and publish the revised version here. Updates do not automatically amend existing separate contracts or retrospectively change already agreed rights and obligations. Where consent to a change is legally required, publication alone does not replace it.
Please contact the website operator at verwaltung@mse-group.com with questions about these terms. For business inquiries, use our US contact page.
